Stand-Alone License Agreement
Clark Labs software described in this document is protected by United States Copyright Law and International Treaty provisions. This software remains the property of Clark Labs at Clark University. However, Clark Labs grants the purchaser a non-exclusive license to use this software subject to the terms outlined in this statement.
All Clark Labs stand-alone software products are only supported on platforms employing the Microsoft Windows operating system. The purchaser is permitted to make a backup copy of the software distribution media for the sole purpose of protecting the purchaser’s investment from loss. The purchaser may not rent or lease the software, but may transfer the license upon written agreement from the Clark Labs. The purchaser may not reverse-engineer, decompile or disassemble the TerrSet software, or any of its associated software programs contained on the distribution media.
Unauthorized reproduction or distribution of this program, or any portion of it, may result in severe civil and criminal penalties, and will be prosecuted to the maximum extent possible under law.
The manuals that accompany this software are also protected by United States Copyright Law and International Treaty provisions. All rights are reserved. No part of the manuals may be reproduced, stored in a retrieval system, or transmitted, in any form or by any means, electronic, mechanical, photocopy, microfilm, recording, or otherwise, without written permission of Clark Labs. Direct translation of any part of the manuals is also prohibited without the written permission of the copyright holder.
Multi-Seat License Agreement
In addition to the stand-alone terms and conditions, purchasing a multi-seat software license requires agreement to the following terms of use. Please see the appropriate multi-seat license category below pertaining to the license you purchased. The terms listed below are for academic license agreements. For non-academic multi-seat license agreements, please contact us.
The multi-seat software is supported only on platforms employing the Microsoft Windows operating system. Multi-seat licenses are licensed on networks only, requiring only one server to be registered. All clients must have access to the server on the network. The number of clients is determined by the multi-seat license product purchased. The license activation process requires an internet connection.
Campus License
- Permission to access the Clark Labs software on an unlimited number of university-owned machines.
Campus Maintenance License
- Permission to access the Clark Labs software on an unlimited number of university-owned machines.
- Campus Maintenance Licenses must be renewed on a yearly basis. While the Campus Maintenance is up-to-date, free upgrades will be delivered automatically to the registered user.
5-Seat Student Lab Kit License
- Permission to access the Clark Labs software on up to 5 campus machines concurrently.
- The Student Lab Kit License is for student use only.
15-Seat Student Lab Kit License
- Permission to access the Clark Labs software on up to 15 campus machines concurrently.
- The Student Lab Kit License is for student use only.
Additional Software Licensing Terms and Conditions
The following words, phrases or terms in this Agreement have the following meanings:
- “Campus” is defined as one (1) physical location of an educational degree-granting institution.
- For Lab Kits, “student use” is defined as software usage by students only, in a lab setting, for instance. It does not imply student ownership.
- The software may only be used on computers owned and operated by the institution for which it was purchased. This license may not be transferred to any other individual or institution.
- Other than the Campus Maintenance License, licensee must purchase software upgrades separately, as they become available.
- Deliverable—Upon receipt of purchase order or payment, Clark Labs will deliver the following to the Licensee: One copy of the TerrSet Software and/or the Land Change Modeler for ArcGIS Extension software (software and PDF documentation).
- Payment—Prepayment is required on all orders. Clark Labs accepts checks or money orders drawn on a US bank in US funds, government or educational purchase orders, Visa, MasterCard or Discover credit cards, or electronic transfers via Peer Transfer.
- This Agreement supersedes any previous agreements and understandings between the Licensee and the Clark Labs.
